2.3 Newsletter

  • To send you news, offers, and promotions, where you have opted in. This is subject to the Privacy and Electronic Communications Regulations (PECR) as well as UK GDPR, and you may withdraw consent at any time.

2.4 OMO App

  • If you use the OMO App, we collect location and device information to provide real-time tracking services for your authorised devices.

  • This data is used solely to provide the tracking services you have requested and is not shared with third parties except as described in Section 5.

2.5 Website improvement and security

  • To monitor how you use our website, helping us improve its functionality, security, user-friendliness, and overall service quality.

3. Our legal basis for processing

UK GDPR requires us to have a valid legal basis for each way we use your data. We do not rely on consent alone. Depending on the purpose, we rely on one of the following:

  • Performance of a contract — where processing is necessary to fulfil an order, deliver a device, or provide the tracking service you've signed up for.

  • Legitimate interests — where processing helps us run, secure, and improve our website and services, and we've concluded this doesn't override your rights.

  • Consent — specifically for marketing communications and non-essential cookies, which you are free to withdraw at any time without affecting other processing.

  • Legal obligation — where we must retain or disclose data to comply with the law (for example, tax or accounting records).

See the table in Section 2 for the specific basis and retention period that applies to each purpose.

4. How long we keep your data

We do not keep personal data for longer than necessary. Retention periods vary by purpose and are set out in the table in Section 2. Where no fixed period is stated, we retain data for as long as your account is active, or as needed to comply with our legal obligations, resolve disputes, and enforce our agreements.

5. Do we share your data with others?

We do not sell your personal data. We share it only with the following categories of recipients, and only to the extent necessary:

  • Delivery and logistics partners — to dispatch your device to the postal address you provide.

  • Payment processors — to process your order securely.

  • Website hosting — Squarespace, which hosts our website.

  • Cloud infrastructure — Google Cloud, which supports parts of our systems.

  • Our App and tracking service supplier — a China-based development partner that operates the backend systems for the OMO App and device tracking service (see Section 6 for how we safeguard this transfer).

  • Customer support tools — to manage and respond to your queries.

  • Public authorities or regulators — where required by law.

Any third party that processes data on our behalf is bound by a data processing agreement requiring them to protect your data to the same standard as we do.

Where you add a contact to your child's device, you are providing us with that person's name and phone number. We process this data on the basis of our legitimate interest in enabling the safety feature you have configured, and by adding a contact you confirm that you have their permission (or, where the contact is also a child, their parent's permission) to do so.

6. International data transfers

Some of our service providers are located outside the UK. We use Squarespace to host our website and Google Cloud for parts of our infrastructure, both of which are US-based providers; we rely on their standard contractual safeguards (such as the UK International Data Transfer Agreement or equivalent Standard Contractual Clauses) for these transfers.

Some parts of our tracking service and App are built and supported by a specialist technology partner based in China. We work with this partner under contractual and technical safeguards designed to protect your data, including the UK International Data Transfer Agreement, additional security and access controls, and a transfer risk assessment carried out before relying on them. As China does not currently benefit from a UK adequacy decision, we take these extra steps deliberately, rather than relying on adequacy alone.

In order to provide the tracking service, this partner has access to the following data:

  • The email address of the App user (the parent or guardian).

  • The stated relationship between the App user and the child (for example, mum, dad, guardian).

  • The phone number of the child's device (the watch).

  • The real-time and historical location of the child's device, which will generally correspond to the location of the child.

  • The names and phone numbers of contacts authorised to reach the watch, which may include other parents, family members, or children.

We recognise that location data and data relating to children calls for extra care, which is why the safeguards above are in place. We are also actively working towards bringing this processing in-house.

7. Your rights

Under UK GDPR, you have the following rights in relation to your personal data:

  • Right to confirmation — to ask whether we are processing your data.

  • Right of access — to obtain a copy of the personal data we hold about you.

  • Right to rectification — to have inaccurate or incomplete data corrected.

  • Right to erasure — to request deletion of your data where it's no longer needed, or you withdraw consent.

  • Right to restriction of processing — to limit how we use your data in certain circumstances.

  • Right to data portability — to receive the data you've provided to us in a structured, commonly used, machine-readable format, and to have it transferred to another organisation where technically feasible.

  • Right to object — to object to processing based on legitimate interests or for direct marketing purposes.

To exercise any of these rights, contact us at support@omo.technology. You also have the right to lodge a complaint with the UK's supervisory authority, the Information Commissioner's Office (ICO), at ico.org.uk, or by calling 0303 123 1113.

8. Account deletion and data removal

If you would like to request deletion of your account and associated personal data, please follow these steps:

1. Send us a request

  • Email support@omo.technology with your account username or email address, and a statement confirming you wish to delete your account and data.

2. Data review

  • We will review your request and verify your identity before processing the deletion. We may contact you for further information if needed.

3. Account deletion

  • Once confirmed, we will permanently delete your account and associated personal data within 3 working days. This action cannot be undone.

We may retain certain data where required by law or for legitimate business purposes, such as resolving disputes or meeting legal obligations, even after account deletion. If you'd prefer to keep your account but limit certain uses of your data, contact us to discuss opting out of specific features instead.

9. Cookies

We use cookies and similar technologies on our website. These fall into the following categories:

  • Strictly necessary cookies — required for the website to function (for example, keeping you logged in or remembering items in your basket). These do not require consent.

  • Analytics cookies — help us understand how visitors use our site so we can improve it. These are set only with your consent.

  • Marketing cookies — used to measure the effectiveness of our promotions. These are set only with your consent, in line with PECR.

When you first visit our site, you will be asked to accept or manage non-essential cookies. You can change your preferences at any time through your browser settings or our cookie management tool. Disabling cookies may affect some website functionality.

10. Children's data

Our device is designed to be worn by children, with the App and account managed by a parent or guardian. Because our service is likely to be accessed by children, we aim to follow the principles of the ICO's Age Appropriate Design Code (Children's Code), including collecting only the data necessary to provide the tracking and safety features of the device, and applying privacy-protective settings by default.

We do not knowingly allow children to create or manage their own account; account registration is carried out by a parent or guardian, who is responsible for the accuracy of the information provided, including the contacts authorised to reach the child's device. If you believe a child has set up an account independently, or that data about a child has been provided to us without appropriate parental involvement, please contact us so we can review and, where appropriate, delete it.

11. Links to third-party websites

Our website and App may contain links to third-party websites or services that we do not operate or control. This Privacy Policy does not apply to those third-party websites or services. We recommend reviewing their privacy policies to understand their data practices.

12. Changes to this Privacy Policy

We may update or modify this Privacy Policy from time to time. Any changes will be effective upon posting the revised policy on our website, and we encourage you to review it periodically. Your continued use of our website or App after any changes means you accept the revised policy.

13. Contact us

If you have any questions, concerns, or requests regarding this Privacy Policy, please contact us at support@omo.technology. We will respond to your enquiry as soon as possible.
